NRA Asks SCOTUS to Hear New Concealed-Carry Case

The NRA recently filed an amicus brief asking the U.S. Supreme Court to hear a new case regarding our right to bear arms outside the home following the state of New York’s reaction to the landmark decision in New York State Rifle & Pistol Association v. Bruen (2022).

“In response to the NRA’s victory in Bruen, which secured every American’s right to carry arms, New York passed the ‘Concealed Carry Improvement Act,’ severely restricting carry throughout the state. The 2nd Circuit upheld many of those restrictions. Today, NRA filed an amicus brief asking the Supreme Court to hear that case, Antonyuk v. James,” wrote the NRA Institute for Legislative Action (ILA).

“Many NRA members wish to carry firearms for lawful purposes in the public places that the State now deems gun-free zones,” reads the amicus brief.

The “Concealed Carry Improvement Act,” which was passed after the Bruen decision, replaced the previous “proper cause” criteria for carrying outside the home with a new standard that it dubbed “good moral character.” This is defined as “having the essential character, temperament and judgement” to have a firearm and not endanger oneself or others. This new standard is even more subjective than the previous one, and New York is not alone in enacting such a standard to deliberately disregard the Bruen decision.

“Contrary to what the name would suggest, the law replaced the ‘proper cause’ criteria with an as-questionable ‘good moral character’ standard, plus requirements that the applicant provide licensing officials with a list of current and past social-media accounts, the names and contact information of family members, cohabitants, and at least four character references, and any ‘other information required by the licensing officer.’ The law would make almost every public place a no-carry zone, and for good measure, sweeps in private property (making the default status no-carry unless it is posted otherwise),” reported NRA-ILA of the act.
